The first of three commentaries on “A Defense of Genetic Discrimination,” from the July‐August 2013 issue.

The topic of professionalism has dominated the content of major academic medicine publications during the past decade and continues to do so. The message of this current wave of professionalism is that medical educators need to be more attentive to the moral sensibilities of trainees, to their interpersonal and affective dimensions, and to their social conscience, all to the end of skilled, humanistic physicians. Urgent calls to address professionalism from such groups as the Association of American Medical Colleges, the American (...) Board of Internal Medicine, and the Accreditation Council for Graduate Medical Education, among others. In fact, at the 2004 annual meeting of the AAMC six separate presentations addressed professionalism with such titles as "Evaluating Humanism and Professionalism," Professionalism: Expectation, Education, Evaluation," or "Toward Assessing Professional Behaviors of Medical Students through Peer Observations". Professionalism, then, has become part of the current academic medicine parlance, used by administrators, clinical faculty, residency programs, and professional organizations with an expectation of shared meanings and goals. All of these stakeholders focus on what has become a consistent list of attributes deemed to be the essence of professionalism, which usually include variations on altruism, duty, excellence, honor and integrity, accountability, and respect. In fact, most of the scholarly work to date has been listing, describing, decrying, and measuring/evaluating it. In this collection of essays, we don’t argue with these attributes. Instead, we ask questions of the discourse from which they arise, how the specialized language of academic medicine disciplines has defined, organized, contained, and made seemingly immutable a group of attitudes, values, and behaviors subsumed under the label "professional" or "professionalism." This collection aims to be a critical text, one that questions the profession’s beliefs about the nature of its work and how such beliefs are enacted in medical education, particularly as they fuel the professionalism discourse. In addition, we will scrutinize how the discourse is enacted in both the formal and hidden curriculum, and in the larger medical environment. (shrink)

This book is the most comprehensive and rigourous critique of the ways disciplinary boundaries still inhibit knowledge-production and integration.

In this paper the authors argue that the exploration of the nature of needs and rights should begin with the actually existing organization of care and of justice in society. The authors raise two key concerns with this organization: 1) the invisibility of care to some, and 2) the inaccessibility of rights to others. Recent work by care scholars has called attention to the ways the current organization of care work perpetuates the myth of self-sufficiency for some, while reducing others (...) to mere dependents. Law and Society scholars have demonstrated the problems of uneven access to legal remedies within the current organization of the legal system. Addressing these concerns simultaneously reveals both the problems of the current organization of needs and rights as well as illuminating alternative possibilities. The authors argue, first, that a justice perspective, based on rights is inadequate because its presumed universality is belied by the reality of the inaccessibility of rights to many. Second, the authors argue that a care perspective, currently formulated upon the assumption that only some people have needs, is also flawed because its presumed particularity distorts the human experience and subsequent policies. Instead, the authors need to conceive of care in a public way that permits both rights and needs to be understood as applicable to all. The authors propose some initial thoughts about how to create such a public concept of care. (shrink)

An empirical study of whether the ordinary conception of race in the United States is biological or social, and how different conceptions connect to racism.

In proposition 7 of the second part of the Ethics, Spinoza famously contends that the “order and connection of things is the same as the order and connection of ideas.” On this basis, Spinoza argues in the scholium that thought and extension are different ways of conceiving one and the same substance: “the thinking substance and the extended substance are one and the same substance, which is now comprehended under this attribute, now under that”. Less famously, in the same scholium, (...) Spinoza insists that the relation of thought and extension is not the only issue at stake. He notes that “certain Hebrews” saw, “as if through a cloud,” the unity of God and the world in knowing: “they maintained that God, God’s intellect, and the things understood by him are one and the same.” The cloud is the idea of divine transcendence. Commenting on this passage, Aviezer Ravitzky has observed that Spinoza’s mention of these “certain Hebrews” should inform us about “an inherent problem, about dynamite concealed in the teachings of the Jewish Aristotelians such as Maimonides.” If, as Aristotle argues in the De Anima and Metaphysics, the knower and the known are one in knowing, then the distinction between God and the objects of God’s knowing is undermined. Noetic union is ontological union, for the intellect is its ideas. Thus Aristotelian noesis undermines divine transcendence. E2p7 and its scholium, then, presage the most famous—or infamous—expression of the Ethics, Deus sive Natura. Maimonides qualifies his Aristotelianism with an hierarchical emanationist cosmology, thereby avoiding the implications of noetic union by differentiating between the creator and the creatures and between the agent intellect, the lowest of the celestial spheres and source of the human acquired intellect, and the divine intellect. Gersonides, the fourteenth century giant of the medieval Jewish tradition and its most consistent Aristotelian, endorses the Aristotelian formula, arguing consistently that the intelligible is an intellect and offering a meticulous explanation of “why it is said of non-material things that the intellect, the thinker, and the intelligible are all one.” In this article, I argue that Gersonides’ own highly Averroian position is evoked in E2p7s and that Spinoza extends and radicalizes the Gersonidean inheritance. Beginning from E2p7 and its scholium, I explore the implications of noetic union for the relationship of God and the world and that between thought and extension. (shrink)

The continued development of General Circulation Models (GCMs) towards increasing resolution and complexity is a predominantly chosen strategy to advance climate science, resulting in channelling of research and funding to meet this aspiration. Yet many other modelling strategies have also been developed and can be used to understand past and present climates, to project future climates and ultimately to support decision-making. We argue that a plurality of climate modelling strategies and an equitable distribution of funding among them would be an (...) improvement on the current predominant strategy for informing policy making. To support our claim, we use a philosophy of science approach to compare increasing resolution and complexity of General Circulation Models with three alternate examples: the use of machine learning techniques, the physical climate storyline approach, and Earth System Models of Intermediate Complexity. We show that each of these strategies prioritises a particular set of methodological aims, among which are empirical agreement, realism, comprehensiveness, diversity of process representations, inclusion of the human dimension, reduction of computational expense, and intelligibility. Thus, each strategy may provide adequate information to support different specific kinds of research and decision questions. We conclude that, because climate decision-making consists of different kinds of questions, many modelling strategies are all potentially useful, and can be used in a complementary way. (shrink)

We investigate if private family firms have a greater environmental performance focus than nonfamily firms, and if this relationship is moderated by the strength of the firms’ social embeddedness. We empirically test these issues using a representative sample of 1452 private Australian small and medium-sized enterprises. Contrary to prevailing assumptions and previous indicative findings in the public firm context, our results show that family firms have a lower environmental performance focus than nonfamily firms. However, in cases where the firm is (...) highly embedded in the social community, we find that family firms have a higher environmental performance focus. We explain our unexpected results by considering the role of financial risk in publicly held family firms. Accordingly, we posit that prior findings in the public firm context may be evidence of families expropriating wealth from nonfamily shareholders rather than altruistic pro-environmental behavior. In a series of powerful and challenging articles emerging since the mid-1990s, Brian Leiter has argued that certain theoretical strains in contemporary legal philosophy are ‘epistemologically bankrupt’, in virtue of their reliance on misguided argumentative devices: analysing concepts, such as the concepts of law and of authority; and doing so by appealing to intuitions regarding the correct way to understand the concepts in question. In response to this state of affairs, Leiter advocates that jurisprudence ought to attempt to catch-up with (...) ‘naturalistic’ developments which have influenced the direction of other branches of philosophy – such as epistemology, philosophy of mind, and moral philosophy – in the last few decades. This article offers a critical analysis of some of Leiter’s proposals for what Jurisprudence should become, in light of his views on the relevance of naturalism for this discipline. (shrink)

Alvin Plantinga, in some essays recently published and presented, defends the rationality of a belief in the existence of God on the grounds that it is foundationally justified. Though this belief does not appear to be justified were we to adopt what Plantinga calls classical foundationalism, there are other, less restrictive versions of foundationalism. Plantinga urges that we recognize that a belief in the existence of God can be warranted within one of these frameworks.

There is general agreement among ecofeminists regarding the desirability of a variety of expressions of ecofeminism, but this pluralism is under threat with the emergence of an approach that emphasizes the primacy of a philosophical ecofeminism which claims the authority to prescribe what ecofeminism should be. The recent anthology Ecological Feminism is symptomatic of this trend, with contributors who affirm the philosophical significance of ecological feminism by privileging philosophers’ voices over those of other ecofeminists, rather than by engaging in critical (...) dialogue with, and exploring connections between, different ecofeminist discourses. This colonizing strategy actively excludes many women’s voices from the creation of an environmental ethic, including those of activist, spiritual, and “Third World” ecofeminists, but fails to offer any adequate philosophical grounds for doing so. In this paper we assess the explanatory role of idealizations in ‘design explanations’, a type of functional explanation used in biology. In design explanations, idealizations highlight which factors make a difference to phenomena to be explained: hypothetical, idealized, organisms are invoked to make salient which traits of extant organisms make a difference to organismal fitness. This result negates the view that idealizations serve only pragmatic benefits, and complements the view that idealizations highlight factors that do not make a difference. This (...) analysis in particular strengthens the perspective that idealizations are means to highlight difference making factors, and identifies a novel, more direct role for idealizations in doing so. It thus offers a novel argument why in some explanatory contexts idealizations are in-eliminable. (shrink)

The major religions are committed to incompatible world-views. Are there criteria available on the basis of which we can rationally decide among these sets of religious beliefs? Ninian Smart in Reasons and Faiths assumes that there is no a priori reason to suppose that such criteria are not possible or unavailable, and sets out a procedure for the justification of religious beliefs which primarily, though not exclusively, depends upon an appeal to religious experience. This article studies a series of provocative references to Spinoza by Jacques Derrida and Giorgio Agamben. For both contemporary philosophers, the context is discussions of eating, a subject matter that turns out to involve such central issues as subjectivity, nature, ethics, and teleology. Each situates Spinoza in a counter-history of philosophy and suggests that Spinoza constitutes an important resource for contemporary reflections. Through an analysis of the three philosophers' texts about eating, nutrition, and being metabolized, I argue that Spinoza's nonteleological, (...) nonhumanistic conception of nature remains a radical possibility, even in the face of contemporary attempts to think outside the canonical discourses of transcendental subjectivity, technological reason, and teleological ethics. Spinoza's position is, in the end, more uncompromising than that of Derrida or Agamben. (shrink)

Socrates is both the first thoroughgoing moral philosopher and the first to employ irony as a philosophical tool. These innovative and foundational aspects of Socratic philosophy, however, lead to apparent inconsistencies and worrisome interactions. Socrates is charged with making his interlocutors look foolish, arrogant, self-serving, or ignorant. Worse still, he seems aware of these reactions. If Socrates knows his methods stir resentment, why does he continue with them? Furthermore, how should we view irony in light of Socratic ethics? I argue (...) that Socrates uses irony and shame to bring about the desire for moral improvement. Socratic irony is of the riddling variety and the shame that it produces is not intended to belittle the interlocutor’s sense of self. Instead, shame is an appropriate response to the realization that one’s life is unexamined and possibly vicious. Therefore, the real problem with Socratic irony lies not with its use, but its failure rate. (shrink)

What comprises ‘data’ varies from one institution to another based on the information which is deemed important by individual institutions. To effectively and efficiently produce, collect, and retain data, an organization develops specific defining characteristics of data to meet its informational needs. Procedures to maintain and retain knowledge among laboratory members and principal investigators will allow for improved efficiency of data collection. Optimization of communication, maintenance of inventories, record keeping, and updating relevant training programs are all critical to supporting the (...) quality and integrity of a particular organization’s data. Concurrent revisions to such procedures will ensure that the definition of data as well as the means by which it is collected and maintained remain appropriate to the needs of the individual organization. In this Article, Professor Suk defends the moral legitimacy of liberal states’ legal protection of minority languages. Many opponents of minority language protection have argued or assumed that legal intervention denies individuals the right to choose the majority language and the economic opportunities often attached to the dominant language. This Article argues that such arguments overlook another category of goods that are necessary to individual autonomy: relational resources. Individuals have an interest in maintaining their ancestral languages because doing so is (...) essential to maintaining one’s relationship to one’s family and community. The relational interest cannot easily be compared with economic opportunities, because these two dimensions of autonomy are incommensurable. As a result, a liberal state should avoid forcing its citizens to choose between these incommensurable goods. By adopting policies that protect minority languages, while also ensuring individuals’ access to economic and political participation in the majority language, a liberal state can manage and balance the conflict between these important competing aspects of autonomy. I identify issues of philosophical concern in Eldred v. Ashcroft, the U.S. Supreme Court’s decision on copyright extension, and encourage the participation of philosophers in these public policy debates. Philosophers have contributions to make to the dialogue not captured exclusively by the technical and often narrow legal debate in the courts.
